Fahd Abdul-Karim Mufdhi Abu Al-Othm Al-Nsour, Minister of State for Legal Affairs.

He was born in Jordan in 1934. He obtained his law degree from Damascus University in 1959. Al-Nusour held many positions, including the public prosecutor and judge in various courts. From 1972-1974 to 1978 he worked as a legal advisor in the Council of Ministers. He headed the Supreme Court of Jordan from 1988-1997.

Rarely did he meet in a gentle personality such as his experience, morals, knowledge and daring, both during his long work in the sectors of law, judiciary, publications, publishing and the ministry, all of which he left fingerprints and exploits, and treated or defused many issues, situations and crises with care and wisdom.

 

The suffering of the Jordanians was in a newly born country: its homes are of mud, its streets and roads are of dust, its waters are brought back to its sources by citizens and transported by drums on the backs of animals, and where illiteracy prevailed in all classes, and ignorance spread in society, and the opportunity to learn was only available to the few young people, and schools They exist only in a few villages, and they were doomed not to go beyond the third grade of primary school, and then the second grade of secondary, except for one school that was able to complete secondary education in full; That is, Al-Salt Secondary School. It is certain that from the latter, a few students graduated who are rightly considered to be among the best of benefactors; Only some of them continued their university studies, including our friend (Fahd), who overcame all these impossible circumstances with a solid will, and with the awareness of his family, specifically his father, and later had what he wanted; He has been in the legal work as a practicing/experienced lawyer for a period of nearly (20) years, although in the judicial sector in its various aspects; In the ordinary, administrative and constitutional judiciary, which was often in his practical practice, not only as a judge but as a lawyer as well – in addition to the main tasks he was entrusted with in organizing international conventions in the fields of human rights and combating extremism and terrorism..etc.. In addition to his practice The origins of legislation and its provision of modern and striking constitutional and legal fatwas in the Legislation Bureau. How can he not, and he has always believed that work in the fields of law and the judiciary is harsh and arduous, and a responsibility whose value can only be appreciated by those who are aware of the extent of their responsibility towards the idea of ​​justice and justice, and who realize that the judiciary and the legal profession are two sides of the same coin, there must be cooperation between them within a framework of commitment to the provisions of the law And that there are differences in viewpoints in any matter, and that a difference of opinion should not spoil a friendly case, and that the development of the judiciary is based on professional training and assistive judicial bodies and the adoption of modern technology.

Fahd took his legal and judicial work and their literature with all the required seriousness, sensing the highness of the mission entrusted to him; Whether as a judge and as Vice-President of the Jordanian Constitutional Court throughout its constitutional term between 2012 and 2018, or as a judge and head of a panel in the Supreme Court of Justice between 1989 and 1997, or as President of the Supreme Administrative Court of the League of Arab States in Cairo in 2006, or as a legal advisor Trusted and active in the Legislation Bureau in the Jordanian Prime Minister for two terms between 1974 and 1978, and the years 1988 and 1989, after he had worked as a public prosecutor, then a judge in the beginning, then a judge of appeal in Maan, Ramtha, Karak, Nablus, Jerusalem and Amman, and thus the period he spent in the wire The Jordanian judiciary (27 years), during which our friend “Abu Maan Al-Nusour” “Nesra” flew with other eagles of that beautiful time, focusing – as is his custom – in any legal situation or decision; On the reasoning and causation and how to extract the evidence on which it is based, in addition to the method of formulating the decision as a wonderful piece of literary art and in a clear Arabic language – which is what distinguished it – following the trail of the professors of constitutional jurists and Egyptian judges.

 

As for the media field; Our friend occupied the position of Director General of Publications and Publishing for a period of nearly two years. He defined and defined the value of the word and its connotations, and its role in raising awareness to raise the level of honesty and transparency among nations, and presented in it bold, honest and striking practical examples; such as abolishing the prior censorship of newspapers and limiting himself to self-censorship; So that journalists feel that their responsibilities are no less than his responsibilities as an official and they must exercise them, and he allowed Arab newspapers to enter the country despite some of them abusing Jordan so that the citizen discovers the truth of the matter himself, and he persuaded the Prime Minister and Minister of Information at the time to challenge the administrative decision to suspend or disable any newspaper, other than his coordination and communications Continuing with the head of the Journalists Syndicate at the time, Mr. Arafat Hegazy and the late Juma Hammad, Ibrahim Sakkijh and others, in order to convey the facts professionally and impartially; and to a professional media that accepts the plurality of ideas and trends and the difference of opinions; It raises the national constants and the interest of the country within clear and specific national laws.

As for his political work, his participation in the executive authority as minister of legal affairs or justice in the mandate; He illuminated many ways before him, and how could he not be arrogant and fill himself with pride and dignity, and he is the believer that his ministerial position and responsibilities are to serve truth and justice, and not for any immediate personal interest or for personal gain or for worldly prestige. A sense that he applies the provisions of laws and the constitution and the spirit of the texts and objectives for which it was established in achieving equality among all, spreading the spirit of justice among citizens and exercising freedoms within the limits set for them in the constitution.

Fahd was – and still is – a fighter who was not intimidated by the force of the blows. It has been proven in history that victory in life is obtained by a greater proportion of those who bear the blows, not those who inflict them! Because the constant is from the course of life; That hard work and diligence are the key to success, and that success depends on the cornerstone of the one who shakes off the dust and rises to move forward with what he was determined to do, and that insistence on acquiring knowledge and knowledge is a first step on the ladder of success that you cannot climb with your hands in your pocket, as he described it. His love for his work was the secret of his success. He was passionate about the judiciary, so he wrote success, success and distinction. In this context, it should be noted that our friend His Excellency “Abu Maan” obtained a Bachelor’s degree in Law from the Syrian University in 1958, and has many published books and research, including the book: “Constitutional Judiciary between Theory and Practice” and the book: “Administrative Judiciary between Theory And the application,” which is located on (750) pages, and was presented to him by the great jurist, Dr. Ahmed Kamal Abul-Majd, describing it as “the precious travel” and “the comprehensive encyclopedia”, a book: “From the Corridors of the Judiciary”, a book: “The Role of the Independent Arab Judiciary in Developing a Culture of Civil Society”, and a book: “From the Harvest of the Years: Hot Research in Contemporary Issues” And a book: “Judicial Pleadings in Administrative Cases.” He participated in many conferences, and has many research and articles in law, politics, and literature. He prepared many working papers for research centers in Amman, Cairo, Geneva and Uganda.
